Topic Overview

Often committee members do not understand their responsibilities. This session will unpack the potential legal liability that may ensue as well as examples where legal defence claims have been made in Schemes and Associations. In addition, Committee Code of Conduct guidelines will be explored.

This session will clearly demonstrate suggested methods on how to best communicate to Owners Corporations and Associations on what they must maintain within their Scheme or Association. Illustrations of the types of communications and publications that can be used to connect with clients will be provided. In addition, examples of legal claims where property has not been maintained will be illustrated clearly for participants to utilise in future discussions with their clients.

Learning Outcomes

Participants will gain an understanding of:

  • How to effectively communicate to Owners Corporations their responsibilities for maintenance of common property
  • The responsibilities of the Committee Office Bearers
  • The possible repercussions if committee members fail in their duties
  • Differences between voting as an owner at AGMs and as a committee member at committee meetings
